The Malmesbury Regional Court sentenced Denico Leander and Adriaan Pietersen to six life sentences each for rape.

The court ruled that the sentences will run concurrently, meaning each will effectively serve life imprisonment.

The attack happened on 17 June 2023 at the Old Scrapyard informal settlement in Malmesbury.

According to court findings, the 32-year-old victim was alone in a shack after others fled following a warning about an approaching gang. The two accused entered and repeatedly raped her.

She later reported the crime to police, leading to their arrest the following morning.

Why it matters

This case shows the seriousness of gender-based violence and femicide (GBV+F) in South Africa.

The court also rejected attempts by the accused to discredit the victim, reinforcing that victim-blaming will not weaken strong evidence.

What you need to know

  • The accused pleaded not guilty and claimed the sex was consensual
  • The State presented medical evidence proving rape and injuries
  • Witnesses supported the victim’s account, including one who hid in the shack
  • The court found no remorse from the accused
  • They were also declared unfit to possess firearms
  • Their names will be added to the National Register for Sex Offenders

The court also allowed the victim to make future representations if the offenders apply for parole.
