The land Claims Court ordered a Gauteng property developer to rebuild 15 houses that it demolished last month.
MaxxLiving was ordered by the court to rebuild the houses of 15 families from Mogale City’s Plot 77 after unlawfully demolishing them. This comes after MaxxLiving allegedly bought the land from the Mogale City Municipality. However, the municipality has denied the allegations of selling or even owning the land.
The court gave MaxxLiving a maximum of 90 days to rebuild all the 15 houses it destroyed.
“The structures will be a minimum of 24m² each. To the extent that any of the occupiers can demonstrate by reference to the footprint, photographs or other evidence that their homes were larger than 24m², the structures will be of such a large dimension.
“The structures will be situated on Portion 77 of the farm Nooitgedacht 534 JQ where the occupiers currently reside,” the ruling reads.
The judgement continues to state that MaxxLiving should ensure that the new site is accessible by car, and that chemical toilets and JoJo tanks be provided by Mogale City and / or MaxxLiving.
