The owners of Enyobeni Tavern, Siyakhangela and Vuyokazi Ndevu, have been found guilty of selling and supplying alcohol to individuals under the legal drinking age. The ruling by the East London Regional Court comes in the wake of a tragic incident in June 2022, which claimed the lives of 21 young patrons at their establishment.

Throughout the trial, the state presented compelling evidence, ultimately establishing beyond reasonable doubt the couple’s culpability in the unlawful sale of alcohol to minors. Despite pleading not guilty, Siyakhangela and Vuyokazi Ndevu took the witness stand in their defense, yet the prosecution’s case remained steadfast.

Nine witnesses, including two underage survivors of the incident, testified against the tavern owners. Following the conclusion of the state’s case, the defense sought a discharge under Section 174 of the Criminal Procedure Act, which was vehemently opposed by the prosecution.

With the application for discharge denied, the case is set to reconvene for sentencing arguments on Friday. Luxolo Tyali, Regional Spokesperson for the National Prosecuting Authority, highlighted that while the criminal proceedings progress, a formal inquest into the tragic deaths of the 21 patrons is pending at the Mdantsane Regional Court.

The conviction of Siyakhangela and Vuyokazi Ndevu underscores the grave consequences of flouting liquor regulations, particularly concerning the protection of underage individuals. This verdict serves as a stern warning to establishments across the nation regarding their responsibility in preventing the sale of alcohol to minors.
