Today, 25 August 2022, the Equality Court in Johannesburg handed down the judgement, on the “Kill the Boer” case against MP Mbuyiseni Ndlozi and Economic Freedom Fighter (EFF) leader Julius Malema.
This case followed after Afriforum brought it before the court and claimed it was hate speech.
The judgement handed down before the court found the song “Kill the Boer”, “Dubul’ ibhunu” does not constitute hate speech. Judge Molahleli says Afriforum failed to prove otherwise nor did the Afriforum witnesses that took stand show that the song was indeed hate speech.
A report by the EFF states that “in a landmark judgement, the court ruled today, that Afriforum failed to show that the lyrics of the song contravene the Equality Act or demonstrate a clear intention to harm or incitement”.
The court ruled out the song as hate speech and that the Afriforum must pay the costs.

After the ruling EFF members rejoiced in court chanting “Kiss the Boer, The Farmer”, other members in support of Malema stood in front of the court singing and chanting as the court proceeded and judgment was handed down.
“The struggle continues for the return of the land, which racist lobby groups such as Afriforum seek to prevent at all costs. Let us all sing liberation songs freely, in honour of the brave heroes and heroines who fought for our political freedom. Kiss The Boer, The Farmer!” stated EFF report.
