The National Prosecuting Authority (NPA) has confirmed its decision to move forward with the appeal of Timothy Omotoso’s acquittal. This follows his departure from South Africa on 18 May 2025. This development comes as the NPA reiterates its commitment to pursuing justice in this high-profile case.
Omotoso’s flight from the country does not block the appeal process, as the South African legal system allows for appeals to proceed without the presence of the accused. Instead, the focus will be on the legal teams representing both sides, along with the judiciary and the Registrar of the High Court and the Supreme Court of Appeal.
The NPA wants to clarify that Timothy Omotoso is not considered a fugitive from justice, as there are no legal restrictions preventing him from leaving South Africa. “His departure signifies that while he may have left, he is no longer a part of this country’s legal processes awaiting an appeal that could take time to resolve,” stated advocate Mthunzi Mhaga, NPA spokesperson.
Should the appeal be successful, the NPA plans to request Omotoso’s extradition, utilizing existing treaties and mechanisms to facilitate the process. This includes the bilateral extradition treaty with Nigeria and the Commonwealth Scheme for extradition.
The NPA remains vigilant in its efforts to ensure that justice is served, regardless of Omotoso’s current location. The organization is committed to exploring every avenue available to bring him back to South Africa if the appeal results in a legal mandate for his return.
