RAF Denounces Trend of People Deliberately Causing Accidents for Compensation

The Road Accident Fund (RAF) has issued a stern warning against the dangerous and fraudulent trend of individuals deliberately throwing themselves in front of moving vehicles in an attempt to claim compensation from the Fund. This alarming behavior not only endangers lives but also places undue strain on the RAF, which is tasked with assessing and processing legitimate claims efficiently.

RAF’s Stance on Deliberate Accidents

The RAF emphasized that it will not compensate anyone who intentionally causes a motor vehicle accident, even if the incident results in serious injuries. The Fund also clarified that in cases of death, beneficiaries of individuals who are deemed the authors of their own misfortune will not receive compensation.

According to the RAF Act, factors such as fault, negligence, and other circumstances are carefully assessed before any claim is approved. While the RAF acknowledges the socio-economic challenges faced by many road users, it stressed the importance of prioritizing road safety and preventing unnecessary accidents.

Declined Claims on the Rise

Between 2021 and 2024, the RAF declined 49,631 claims for various reasons, including:

  • Claimants being solely responsible for the crash.
  • Deaths occurring before the finalization of claims.
  • Injuries being too minor to warrant compensation.
  • Fraudulent claims.

Festive Season Fatalities Highlight Road Safety Crisis

Over the past five years, South Africa has recorded 7,987 road fatalities during the festive season, a period spanning 01 December to 11 January annually. Alarmingly, 84% of these crashes were attributed to human error. Pedestrians and passengers remain the most affected, accounting for 40% and 33% of fatalities, followed by drivers (26%) and cyclists (1%).

The RAF also reminded the public that it does not compensate for the death itself but only covers actual costs related to cremation or burial.

Road Safety Tips for the Festive Season

In light of the upcoming festive season, the RAF urged road users to adhere to these safety tips to reduce accidents:

  • Wear bright clothing when walking after dark.
  • Cross roads safely and avoid running.
  • Avoid drinking and driving.
  • Do not text while driving.
  • Maintain proper tyre pressure.
  • Keep a safe following distance.
  • Avoid driving or walking if feeling unwell.

The RAF reiterated its commitment to supporting road users while promoting safer travel and holiday experiences. By addressing reckless and fraudulent behavior and raising awareness about road safety, the RAF aims to create a more responsible and protected road environment for all.
