The NPA is taking definite steps to address the recent judgment in the Omotoso case, bringing a Senior Counsel to support its team of sexual offense prosecutors. This move comes as the National Prosecuting Authority (NPA) evaluates whether to appeal the release of Timothy Omotoso, acknowledged as a significant and complex legal challenge.

“The importance of this matter cannot be understated,” said Advocate Mthunzi Mhaga, NPA spokesperson. “In accordance with Section 319 of the Criminal Procedure Act, the state can only appeal an acquittal, which underscores the necessity for thorough and informed decision-making.”

The newly appointed Senior Counsel will join the internal team in meticulously reviewing the court transcript along with three pivotal decisions rendered during the trial. This collaborative effort aims to produce a comprehensive memorandum assessing the viability of an appeal.

The judgment has sent shockwaves throughout the fight against sexual and gender-based violence in South Africa, eroding public confidence in the criminal justice system. “This has profound implications for the brave victims involved, as well as for the broader community,” the NPA emphasized. “We are committed to exploring every legal avenue to ensure that justice is served.”
