OPINION: In terms of South African Legal System, every prisoner has a right to Parole

Date:

In terms of South African Legal System, every prisoner has a right to Parole, for so long the Parole Board deems one eligible for Parole, which means that portion of the sentence of imprisonment can be served in the community under the control and supervision of correctional officials subject to conditions set out in section 68 of the Correctional Services Act 1982 (SA)

The former state President was released under Medical Parole which is granted if the offender is terminally ill or suffers from one of the conditions set out in the graphic, if the risk of reoffending is low, and if there are appropriate post release conditions for the inmate’s supervision, care and treatment.

We are all aware that the former president has been in and out of health facilities, which gives us a glimpse of his medical condition hence the medical parole has been granted to him. We are on the view that his release was lawful.
