In a poignant journey spanning two decades, Mr. Benya of Kariega has finally achieved his dream of having a permanent brick home, marking a triumphant end to his tireless battle for an RDP house. The story unfolds as Mr. Benya, a resident since 1988, navigated through years of dashed hopes and uncertain living conditions.

Initially promised an RDP house in 2004, Mr. Benya’s expectations were shattered as the pledged house never materialized, leaving his family in limbo. Despite an offer from the Municipality to relocate to another shack, he steadfastly refused, opting to fight for the home he had been waiting for.

Seeking assistance from Legal Aid SA, Mr. Benya found an ally in Civil Legal Practitioner Ms. Nadia Jordaan from the Kariega Local Office. Through exhaustive research by an independent party, it was revealed that adjustments could be made to construct the house without interfering with the drainage system. Ms. Jordaan filed a complaint, prompting the National Prosecuting Authority to instruct the construction of the long-overdue house.

“I’ve lived here from 1988, my subsidy approval was in 2004 if my memory serves me correctly. I’m grateful to Legal Aid SA, Nadia Jordaan, especially for not giving up on my case. Mentally and emotionally, it’s been hell for me, but finally, my house has been built and handed over in 2023,” shared an emotional Mr. Benya.

Ms. Jordaan’s dedication went beyond securing shelter; it aimed to restore Mr. Benya’s dignity as the head of his household, ensuring the well-being of his wife, children, and grandchildren. Wongi Makhenyane, Head of Office in Kariega, acknowledged the unwavering perseverance of Ms. Jordaan, emphasizing the significance of Mr. Benya and his family spending Christmas in the home they had longed for.

This success story underscores the crucial role of access to legal aid in protecting the rights and dignity of vulnerable individuals. Legal Aid SA’s commitment to providing legal assistance, coupled with Ms. Jordaan’s relentless advocacy, embodies the principles of justice and equality.
