Fraudsters Sentenced for Attempted R31 Million Theft from Road Accident Fund

In a significant victory for justice, a family trio comprising a mother, daughter, and son-in-law has been handed jail sentences for their involvement in a fraudulent scheme aimed at claiming a staggering R31 million from the Road Accident Fund (RAF). The convicts, Tanya Senekal, Jaco Senekal, and Magdil Groenewald, were found guilty of submitting 537 fraudulent claims stemming from 40 road accidents.

The Johannesburg Magistrate Court delivered the verdict last Thursday, imposing stern penalties on the perpetrators. Tanya Senekal and Jaco Senekal were each sentenced to eight years in prison, with two years suspended for five years, on the condition that they refrain from committing further fraud during the suspension period. They faced a total of 403 charges. Meanwhile, Magdil Groenewald received a five-year jail term and may be considered for correctional supervision at the discretion of the Commissioner of Correctional Services or a parole board, having been convicted on 134 counts of fraud.

The fraudsters employed various tactics, including recruiting individuals to fabricate injury claims from car accidents, utilizing old and inactive vehicle number plates, filing claims for accidents with no actual victims, and reusing stolen number plates multiple times.

Expressing the RAF’s standpoint, Chief Executive Officer Collins Letsoalo emphasized the detrimental impact of fraudulent claims on the organization’s finances and resources. He stated, “Fraudulent claims have dire financial and resource implications on the RAF in that employees who handle claims must also sift through fraudulent claims.” Letsoalo stressed the necessity of imposing severe penalties without suspensions for those convicted of defrauding claimants and road users.

The RAF’s Forensic Investigation Department continues to collaborate with the South African Police Services to investigate and prosecute fraudulent activities. Over the past three financial years, the RAF has successfully thwarted fraudulent claims worth over 2.6 billion rand.

In light of these developments, the RAF urges individuals involved in motor vehicle accidents to contact their dedicated Contact Centre on 087 820 1 111 or visit their website for assistance and information regarding claim procedures.

The sentencing of these fraudsters marks a significant milestone in combating fraudulent activities targeting public funds and reinforces the RAF’s commitment to upholding integrity and transparency in compensating accident victims.
