The Eastern Cape Department of Education has rescinded its decision to deregister Bergview College, a private school in Matatiele, following a legal challenge by the school’s management and significant public outcry. This development comes in the wake of allegations that a seven-year-old pupil was raped on the school’s premises in October 2024.
In a letter sent to Bergview College on Tuesday, the department stated, “Kindly be advised that the decision to withdraw the registration of your school as an independent school is rescinded with immediate effect.”
The initial deregistration was met with resistance from the school’s management, who argued that the move by Education MEC Fundile Gade was unlawful. In response, the department emphasized its commitment to resolving the matter and ensuring justice is served. A statement released on Wednesday noted, “The MEC of Education in the Eastern Cape, Mr. Fundile Gade, continues to marshal his department to help resolve the matter and ensure justice is served in the investigation into the alleged sexual assault of a 7-year-old girl.”
Gade highlighted the collaborative efforts with various stakeholders, including other government departments, to support the victim’s family and pursue justice. He acknowledged the solidarity demonstrated by South Africans from all corners and recognized the extensive consultations held with various stakeholders. “The MEC appreciates the support given to the families and the solidarity demonstrated by South Africans from all corners,” the statement continued.
Despite the reversal of the deregistration, the department has made it clear that Bergview College remains obligated to provide a safe and suitable environment for learning. The investigation into the alleged crime remains a priority, with multiple government entities, including the Ministries of Police, Social Development, and Justice, actively involved. The Police Ministry has mobilized its Family Violence, Child Protection, and Sexual Offences Unit (SAPS FCS) to conduct a comprehensive investigation.
Furthermore, the Justice Ministry is pursuing a thorough vetting of all staff members at Bergview College, while social development representatives have stepped in to offer psycho-social support to the victim’s family. The Department of Education is relying on collaboration with the Joint Justice Cluster to navigate the ongoing criminal investigations.
Gade expressed renewed hope, stating, “I am now hopeful that as the ECDoE, we at least contributed in ensuring the wheels of justice turn again and this time they turn fast in favour of Cwecwe and her family.”
The case has garnered national attention, with the social media campaign #JusticeForCwecwe gaining significant traction as the public demands accountability and justice for the young victim.
